Switching provider (Data Act)

Solaryx, Addrly and Flashboard are data processing services within the meaning of Regulation (EU) 2023/2854, the Data Act. This page gives the information that regulation requires, and the contract of each service refers to it.

Your right to switch

You may ask at any time to switch to another provider, or to retrieve your data, giving the notice set by the contract of your service, which never exceeds two months.

  • Transition: when the notice ends, up to thirty days during which the service keeps running, with reasonable help and the information you need to leave. You can extend that period once. Your subscription runs until the period ends.
  • Retrieval: then at least thirty days to retrieve your data, after which it is erased, subject to the retention periods the law imposes.
  • Fees: none. Switching provider and exporting your data cost nothing; converting the data into another system's own format, or setting that system up, is quoted separately.

What you can take with you

The export covers all the data you or your users entered or generated through the service, in commonly used formats: CSV for tables, PDF for signed documents, and your files in their original format.

  • Solaryx: customers, appointments, sessions and exposure times, customer records with skin type and signature, gift card and loyalty balances, online and point-of-sale orders, consents and objections, accounting documents.
  • Addrly: account, lists and portfolios, watch and alert settings, history of the digests sent, usage history, invoices.
  • Flashboard: account, clients, bookings, cash book, designs and photos, invoices.

Only the data specific to how the service works inside is excluded, as HVG's trade secret: source code, database schema, internal parameters and models, technical logs.

Where the data is hosted

  • Solaryx: OVHcloud data centres in France, in the European Union.
  • Addrly: infrastructure in Belgium and in the European Union.
  • Flashboard: infrastructure in Belgium and in the European Union.

HVG Solutions is a company governed by Belgian law, and that infrastructure is subject to the law of the Member State where it is located.

Access by authorities outside the Union

Your data stays in the European Union, encrypted in transit and at rest, and only the people at HVG whose work requires it can reach it, with multi-factor authentication. HVG hands no data to an authority of a country outside the Union unless an international agreement or the law of the Union or of a Member State requires it. It examines any such request, contests it when it does not meet that condition, discloses only the strict minimum, and tells you, unless the law forbids it.

Where a service relies on a provider outside the Union, for instance for the artificial intelligence features of Solaryx, the data processing agreement of that service lists it, with the safeguards that apply.

Prices and charges

  • Standard prices: on the page of each service on this site and in your quotation. The other fees are in the price grid of your client portal.
  • Early termination: nothing, except for the payment terminal and the self-service kiosk of Solaryx, made available for at least six months per device: the fees left until that term are due if it ends sooner, save in the cases listed in article 4 of the Solaryx service contract.
  • Switching charges: none.
